Agreement to Terms
By accessing or using Casino Kernel's services, website, or platform (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Services. These terms apply to all visitors, users, and operators who access or use the Services. We reserve the right to update or modify these terms at any time, and your continued use of the Services following any changes constitutes acceptance of those changes.
Services Description
Casino Kernel provides enterprise B2B iGaming technology solutions, including but not limited to casino platform software, game aggregation, cryptocurrency integration, and custom game development. Our Services are provided on a software-as-a-service basis and are intended for licensed iGaming operators and businesses. Access to specific features and functionality may vary depending on your subscription tier and contractual agreement.
User Obligations
You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must not use the Services in any way that violates any applicable local, national, or international law or regulation. You agree not to attempt to gain unauthorized access to any part of the Services, other accounts, or any systems or networks connected to the Services.
Intellectual Property
The Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Casino Kernel, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Custom games developed under a Game Studio agreement may have separate intellectual property terms as defined in the applicable contract.
Limitation of Liability
To the fullest extent permitted by applicable law, Casino Kernel and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Services. In no event shall Casino Kernel's total liability exceed the amount paid by you to Casino Kernel during the twelve (12) months preceding the event giving rise to the claim.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Malta. If any provision of these Terms is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
